LEGAL REGULATION OF THE UKRAINIAN DOMESTIC EDUCATION IN THE SECOND HALF OF THE XIX CENTURY (BASED ON THE 1834 “DOMESTIC TUTORS AND TEACHERS REGULATION”)

The article deals with the analysis of the domestic tutors and teachers’ state regulation system in the second half of the XIX century. Major attention is given to legal regulation system analysis, and the 1834 “Domestic Tutors and Teachers Regulation”. The latter officially outlines the “Domestic Tutor” and “Teacher” statuses, their responsibilities, educational qualifications, financial support and privileges. Based on the research material, archive documents as well as historical and pedagogical studies, the following finding is made: then-institutionalized legislative regulations of the domestic educational and pedagogical process officially defined and strengthened domestic education. The article also states that the second half of the XIX century was a novel phase of the Russian Empire domestic education development. It lasted through 1917 and was defined by clear legislative regulation system for the domestic teachers and by recognition of the domestic education as a legal component of the national education system in general.

It is also proved that by the second half of the XIX century legally institutionalized were all necessary conditions granting access to education and children upbringing in the private schools: the existence of the person’s special education and moral “reliability”, including political views, loyalty to the royal family and Russian Empire national system. The author founded out that foreigners could also be tutors and teachers. However, the unofficial imperial policy towards them was very special and was aimed at minimizing their influence on the domestic education. Defined in the article are personal and professional requirements for the domestic teachers; it is also stressed that officially introduced were privileges and benefits granted to domestic teachers; the cited document legally approved responsibility for breaking the official norms.
